About Tersia Oosthuizen

An attorney whose personal experiences shape every case she takes on — bringing empathy, tenacity and unwavering integrity to family law in the Greater East Rand Area and across Gauteng.

Tersia Oosthuizen, Attorney Boksburg
Her story

A practice built on lived experience

Tersia Oosthuizen was admitted as an attorney in 1999. After many years of practice, she founded her own independent firm in 2022 — driven by a calling to offer something different: legal representation that combines professional excellence with genuine human compassion.

Tersia possesses an exceptional and deeply personal understanding of the challenges her clients face. She knows what it feels like to stand at a crossroad. That experience is not a footnote — it is the foundation of how she practises law.

A Divorcee, former teacher and single parent, Tersia is especially passionate about the wellbeing of children caught in the middle of family breakdowns. She approaches every children's court matter with both the legal precision and the human sensitivity it deserves.

As a former state prosecutor, Tersia knows both sides of the courtroom — and that insider knowledge is a significant advantage for her criminal law clients. She understands how the prosecution builds its case, where the weaknesses lie, and how to expose those weaknesses. That experience shapes how she prepares, how she negotiates, and how she fights — strategically, and with a clear-eyed understanding of the system from the inside.

Faith is not separate from Tersia's practice — it is woven into it. She approaches every client's matter with the humility, accountability and sense of purpose that come from answering to a higher standard.

Frequently asked questions

What does a family law attorney do?
A family law attorney advises on and represents clients in legal matters involving family relationships — including divorce, children, maintenance, domestic violence and custody and access.
Do I need an attorney for family matters?
While not always legally required, having an experienced attorney significantly improves your outcomes, protects your rights, and reduces the stress of navigating complex legal processes.
How much does family law advice cost?
Fees are discussed transparently upfront, and Tersia works to keep costs reasonable without compromising on quality.
How long do family law matters take?
It depends on the complexity and whether the matter is contested. Tersia always works to resolve matters as efficiently as possible.

Children's Court proceedings — what you need to know

We Concentrate On

  • Applications for and to care and contact orders, such as residence, shared residence and supervised contact.
  • Emergency applications where a child faces immediate risk or is in need of care.
  • We do not entertain or condone:
    • ·Parental alienation in any form
    • ·The notion that contact is conditional on payment of maintenance
  • Tailored parenting plans that address your unique family dynamics, needs and challenges are made an Order of Court.
  • Working closely with qualified professionals, such as therapists and social workers, to obtain independent assessment and progress reports to assist the Court.
  • The best interests of the minor child as the guiding principle — always.

Frequently asked questions

What happens in a Children's Court hearing?
A presiding officer (magistrate) hears evidence, considers social worker reports, and makes an order in the best interests of the child. It is less formal than a High Court but still legally significant.
Can I attend without a lawyer?
Technically yes, but legal representation significantly improves your ability to present your case and protect your parental rights.
How are the child's interests protected?
The court's paramount concern is the best interests of the child. A social worker's report is usually central to the proceedings, and the court may appoint a curator ad litem to represent the child.
How long do proceedings take?
This varies depending on urgency and complexity. Urgent matters can be heard very quickly; others may take several months.

Parenting plans in South Africa — what you need to know

We Concentrate On

  • Drafting.
  • A plan that works for a teenager will not work for a baby.
  • A plan for amicable parents will not work for high-conflict parents.
  • Special provision for:
    • ·Gradually phased in approach
    • ·Blended families and new partners
    • ·Long distance and relocation families
    • ·Assistance with substance abuse and mental health challenges
  • Dispute resolution mechanisms built into the plan — reducing future conflict.
  • Registration with the Family Advocate for full legal enforceability.
  • Making parenting plans orders of court for full legal enforceability.
  • Amendments and variations when existing plans no longer reflect reality.

Frequently asked questions

Is a parenting plan legally binding?
Yes – once made an order of Court.
What if my ex won't cooperate?
Once a parenting plan has been made an order of Court, non-compliance may constitute a criminal offence.
Can a parenting plan be changed?
Yes. If circumstances change materially — such as a relocation, change in the child's needs, or changed work schedules — either party can apply to vary the plan.

Criminal law and bail — what you need to know

We Concentrate On

  • Urgent bail applications – all schedules – whether we need to prove that your freedom is in the interest of justice or that exceptional circumstances warrant your release on bail.
  • Comprehensive consultations, if necessary at prison — and case analysis.
  • Thorough preparation of ourselves and client for trial.
  • Cross-examination and defence case.
  • Plea bargaining where appropriate.
  • Representations to the State.
  • Holding a watching brief — when you are the Complainant and we represent your interests, ensuring your voice is heard and your rights protected throughout the prosecution.

Frequently asked questions

What should I do if I am arrested?
Remain calm, do not make any statements to the police, and contact an attorney immediately. You have the right to legal representation from the moment of arrest.
How does bail work in South Africa?
Bail is an amount of money paid to the court as security for an accused person's release pending trial. The Court considers factors such as the seriousness of the offence, interest of the society and the accused's personal circumstances.
Will I get a criminal record?
If convicted, yes. However, we fight for a Section 174 discharge, a non-guilty finding, a withdrawal, a matter struck off the roll, or diversion — where any of these are available to you.
Do I have to prove I am innocent?
No. You are presumed innocent until the State has proven your guilt beyond reasonable doubt.
Sole guardianship

Sole guardianship

Applications for sole guardianship where one parent needs exclusive authority to make major decisions about a child's life.

WhatsApp now
Sole guardianship attorney

Sole guardianship in South Africa — what you need to know

We Concentrate On

  • Applications for sole guardianship where joint decision-making has broken down or is impossible.
  • Where the other parent is absent, untraceable, deceased or unfit.
  • Urgent applications where a child's welfare requires immediate sole authority.
  • Enabling critical decisions — schooling, medical procedures, travel and passport applications.
  • Edictal citations where the other parent cannot be located.
  • Guardianship in the context of single parenting, blended families and extended family care.

Frequently asked questions

What is the difference between guardianship and custody?
Care (custody) relates to where a child lives and daily parenting. Guardianship relates to major decisions such as consent to travel, marriage or certain medical procedures.
Can the other parent contest a sole guardianship application?
Yes. The other parent has the right to oppose the application and present their own case. The court will hear both sides and decide in the child's best interests.
How long does it take?
An urgent application can be heard within days. A non-urgent application typically takes several months depending on the court roll and whether the matter is opposed.
Do I need to go to the High Court?
Applications for sole guardianship are generally brought in the High Court.

Divorce and Separation — from Shattered Past to Secured, Empowered Future

  • Divorce is one of life's most traumatic and destabilising events — legally complex, emotionally devastating and financially challenging.
  • As a divorcee herself, Tersia Oosthuizen understands this not just professionally, but also personally. Her goal is to guide you towards a fair, dignified resolution — as amicably, transparently and cost-effectively as possible, so that you can focus on healing.

We Concentrate On

  • Civil marriages and customary marriages.
  • Different marriage regimes: in community of property, out of community of property — with or without accrual — and the patrimonial consequences and division of assets and liabilities.
  • Cost-effective and stress-eased process.
  • Dignity restored: you are more than a file number — you have a story to be heard, respected and fought for.
  • Child maintenance, spousal or rehabilitative maintenance — irrespective of gender, where circumstances dictate and the law provides.
  • Forfeiture of benefits — where legal standards of forfeiture are met — to prevent undue benefit.
  • Settlements and litigation — we strive for fair settlements, but we are built for fierce and strategic litigation.
  • Edictal citations and substituted service — where your spouse is abroad or cannot be located.
  • Anti-dissipation orders — to prevent matrimonial assets from being misappropriated before the finalisation of the divorce.
  • Tailor-made parenting plans incorporated in the divorce decree.
  • Interim relief pending finalisation — fathers should not wait for access; mothers should not wait for maintenance, because justice delayed is justice denied.

Frequently asked questions

How long does a divorce take in South Africa?
A contested divorce typically takes 6–18 months depending on the complexity of the issues and court roll. Tersia will keep you informed and up-to-date with progress throughout the entire case.
What is the difference between in and out of community of property?
In community of property means all assets and debts are shared equally. Out of community of property (with or without accrual) keeps estates separate to varying degrees. Any marriage regime can be fairly resolved through well-negotiated settlement.
Do I need to go to court?
In an uncontested or settled divorce usually only the plaintiff has to appear. This is entirely up to the different courts.
Can we divorce if we don't know where our spouse is?
Yes through a process called edictal citation / substituted service. Tersia can guide you through this.
Can my spouse refuse to divorce?
No, he / she can oppose it, but not stop it. Divorce is based on an irretrievable breakdown of the marriage.
Domestic Violence and Harassment & protection orders

Domestic Violence and Harassment & protection orders

Tersia Oosthuizen provides urgent, compassionate legal support for victims of domestic abuse, harassment and gender-based violence. You are not alone — and you have rights.

Domestic violence attorney

Protection orders and your legal rights

The Domestic Violence Act (Act 116 of 1998) provides strong legal protections for anyone experiencing domestic abuse — regardless of gender. Tersia approaches every matter with the seriousness, sensitivity and urgency it demands.

If you are harassed, stalked or intimidated by someone who is not in a domestic relationship with you, e.g. neighbours, former partners, colleagues, you may seek relief under the Protection from Harassment Act 17 of 2011.

We Concentrate On

  • Urgent interim protection orders — drafted, amended and served on the other party urgently when your safety cannot wait.
  • Domestic violence in all its forms: physical, emotional, verbal, financial, sexual abuse, etc.
  • Harassment: such as stalking, bullying, and harassment on social media.
  • Guiding you through the process with sensitivity — court can feel overwhelming; we make it manageable.
  • Enforcement of protection orders where an order exists but is being ignored.
  • Hearings to confirm interim protection orders.
  • Opposing unjust protection order applications.
  • Criminal charges arising from Domestic Violence.
  • Your voice matters — we prepare you, accompany you and fight for you.

Frequently asked questions

How quickly can I get a protection order?
An interim protection order can often be obtained the same day you apply at the Magistrates' Court. Tersia can help you prepare the application urgently and accompany you to court.
What happens if the abuser violates the protection order?
Violating a protection order is a criminal offence. The abuser can be arrested immediately. You should contact SAPS (10111) and then inform Tersia so further legal steps can be taken.
Do I need to have been physically hurt to apply?
No. Emotional abuse, threats, harassment, stalking and financial control all constitute domestic violence and harassment under South African law. You do not need to have been physically injured. The abuser can be arrested immediately, at the instance or pursuant to a warrant for arrest issued together with the protection order.
Do I need a lawyer to apply for a protection order?
You can apply without a lawyer, but having Tersia's assistance significantly improves the quality and completeness of your application and ensures your rights are fully protected at the hearing.
Maintenance, custody & children's court

Maintenance & children's rights

As a single parent herself, Tersia is deeply passionate about protecting children's wellbeing and financial support. She fights to ensure children receive what they are legally and morally entitled to.

WhatsApp us
Maintenance attorney

Protecting your children's future

Every child has the right to maintenance from both parents, regardless of whether the parents were married. Tersia Oosthuizen is passionate about enforcing these rights and ensuring that children are never used as pawns in adult disputes.

We Concentrate On

  • Applications for child maintenance — every child has a right to be supported.
  • Spousal and rehabilitative maintenance — irrespective of gender, where circumstances and the law provide.
  • Enforcement of existing maintenance orders.
  • Variation applications — when financial circumstances change.
  • Tracing and attachment where a maintenance debtor attempts to evade obligation.
  • Garnishee Orders.
  • Preparing and insisting on complete financial bundles for the sake of transparency and justice.
  • Interim Maintenance Orders (Rule 43 and Rule 58) pending finalisation of the divorce.

Frequently asked questions

How is child maintenance calculated?
The court considers the child's reasonable needs and the financial means of both parents. Both parents contribute in proportion to their income. Tersia will help you prepare a full financial disclosure and argue for an appropriate amount.
What if the other parent refuses to pay maintenance?
Failure to pay maintenance in terms of a court order is a criminal offence under the Maintenance Act. Tersia can pursue enforcement through garnishee orders, attachment of assets, or criminal prosecution.
Can I relocate with my child without the other parent's consent?
Generally, no — if the relocation would substantially change the contact arrangements. Court approval or written consent from the co-parent is required.

Resolving civil disputes effectively

Civil litigation covers disputes between individuals, businesses, and organisations that are resolved through the courts rather than the criminal justice system. Tersia Oosthuizen brings many years of legal experience to every civil matter she handles.

We Concentrate On

  • Letters of Demand, Acknowledgements of Debt, Summonses, Judgments, Warrants for Execution, Pleadings, Civil Trials – the full litigation process.
  • Applications / Notices of Motion.
  • Defending claims brought against you – with the same tenacity we bring to prosecution.
  • Debt recovery — pursuing what is lawfully owed to you.
  • Motor vehicle accidents – where RAF does not apply.
  • Claims in terms of goods sold and delivered, services rendered, monies lent and advanced.
  • Rescission of Judgment.
  • Magistrates' Court and High Court matters.
  • Settlement negotiations — resolving disputes without the cost and delay of trial where possible.

Frequently asked questions

How long does civil litigation take?
Timeline varies significantly by complexity and court roll. Simple debt matters may resolve in weeks; contested High Court matters can take 1–3 years. Tersia sets realistic expectations at the outset.
What are my chances of winning my case?
Tersia will give you an honest, balanced assessment of the merits of your case at your initial consultation — and throughout — including the risks and costs involved. She will never advise you to pursue litigation that is unlikely to succeed.

Securing your future with sound legal planning

A well-drafted will and the right marriage contract are two of the most important documents you will ever sign. Tersia Oosthuizen drafts these with meticulous care, ensuring they accurately reflect your wishes and withstand legal scrutiny.

We Concentrate On

  • Drafting a valid, enforceable will that truly reflects your wishes.
  • Updating existing wills after major life events — divorce, remarriage, birth of children.
  • Antenuptial contracts — protecting what you bring into a marriage and what you build together.
  • Choosing the right matrimonial property regime with full understanding of the consequences.
  • Universal partnerships (cohabitation agreements) for unmarried partners.
  • Plain-language explanation of every document — you sign nothing you do not understand.
  • Peace of mind that your affairs are in order and your loved ones protected.

Frequently asked questions

Do I really need a will?
Yes. Without a will, your estate is distributed according to the Intestate Succession Act, which may not match your wishes. A will also allows you to appoint a guardian for minor children — one of the most important decisions any parent can make.
When must I sign an antenuptial contract?
An ANC must be signed and notarially executed before the wedding date. If you fail to enter into such ANC, you are automatically deemed to be married in community of property.
How much does a will cost?
Tersia offers competitively priced will drafting. Contact her office for current rates. A professionally drafted will is one of the best investments you can make for your family's peace of mind.
